This Privacy Policy (or “Policy”) tells you how Liquid Technology (collectively, “Company”, “we”, “us” or “our”) collects, uses, shares, secures, and eventually deletes, information collected from and about visitors to our website.

OVERVIEW

We are an IT asset disposition service provider offering a suite of effective and impartial solutions to help companies manage their excess technology by destroying data and mitigating the risk of recycling liability for a variety of different industries. Our data destruction services either meet or exceed the National Institute of Standards and Technology (“NIST”) 800-88 guidelines, as may be updated, amended, modified, superseded and replaced from time to time. We do not access the data from any of the devices or equipment relinquished to us nor do we maintain that data. 

TYPES OF PERSONAL INFORMATION WE COLLECT

In this Privacy Policy, “personal information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual.  For purposes of this Policy, personal information does not include:

• Publicly available information from government records;
• Deidentified, aggregated or anonymized information that is maintained in a form that is not capable of being associated with or linked to you; and
• Information relating to our employees, contractors, and other personnel.

When you visit our Website or interact with one of our representatives we may collect certain pieces of personal information about you, including but not limited to:

• Identifiers, your name, business email address, business physical address, business telephone number, and device identifiers.
• Commercial information, services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

We collect Personal Information about you from the following sources:

This may include information about how you use and interact with our Website or otherwise interact with us and information about your device. We may combine information that we receive from the various sources described herein, including third party sources, and use or disclose it for the purposes identified below.

HOW WE USE PERSONAL INFORMATION

We may use personal information we collect for the following purposes:

• To fulfill or meet the reason you provided the information;
• To market to you, including sending you promotional materials or communications regarding services offered by us, or to send you information which we think may be of interest to you. • To provide you with support and to respond to your inquiries, including but not limited to employment inquires, and to investigate and address your concerns and monitor and improve our responses;
• To help maintain the safety, security, and integrity of our Website, services, databases and other technology assets, and business;
• For testing, research, analysis to develop and improve our website and services; and
• To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

Additionally, we may use your personal information as we believe necessary or appropriate to protect our rights, privacy, safety, property, and/or those of others.

HOW WE DISCLOSE PERSONAL INFORMATION

• • Our Service Providers: We disclose your personal information to third parties that provide business, professional, marketing, analytic, or technical support services for us and/or administer activities on our behalf. We make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract.

• Our Industry Business Partners: To the extent we disclose any personal information to our business partners, it is only to provide you with additional services or the services that you have requested. As with our service providers, our relationships with our business partners are governed by agreements that describe the purpose of the disclosure, to the extent one occurs, requires the recipient to keep the information confidential, and prohibits the use of the disclosed information for any purpose except to perform its obligations under the contract. 

• • Governmental and Public Authorities: We disclose your personal information to government and public authorities as necessary or permitted by the laws of any jurisdiction in which we operate, including in response to a subpoena, court order, investigative demand, request for cooperation from a law enforcement agency, or similar request from a self-regulatory body or government agency.

Personal Information Collected

These tracking technologies collect data about you and your device, such as your IP address, operating system, browser used, browser history, search history, and information about how you interact with our Website (such as pages on our Website that you have viewed, including your specific mouse movements, page clicks, and other session replay information).

Disclosures of Personal Information

We may disclose information to third parties or allow third parties to directly collect information using these technologies on our Website such as social media companies, advertising networks, companies that facilitate session replay recordings and analysis, companies that provide analytics including ad tracking and reporting, security providers, and others that help us operate our business and Website.

Your Choices

Some browsers have incorporated Do Not Track (“DNT”) preferences. We do not currently have the ability to honor such signals.

INFORMATION SECURITY

We maintain physical, electronic, and procedural measures designed to safeguard your personal information from unauthorized access and disclosure. However, no system can be completely secure. Therefore, although we take steps to secure your information, we cannot guarantee your information, searches, or other communications will always remain secure.

INFORMATION RETENTION

We will retain your personal information as long as necessary in relation to the purposes outlined in this Privacy Policy and to provide you with services. For example, if you sign up to receive communications, we will store and maintain your personal information to continue to send you these materials until you have opted out of receiving these communications. If you are a potential customer, we only use and store your information until we have provided our service to you. If you become a customer, we only use and store your information until you are no longer our customer. 

We will seek to delete your personal information collected via cookies and other technologies from our website. We also retain your information to satisfy our legal requirements, unless a longer retention period is required or allowed under law. We reserve the right to provide access to or delete personal information only to the extent required by applicable law.

The Website may contain features or links to websites and services provided by third parties, which are not governed by this Privacy Policy. Any personal information you provide to the owner or operator of another website or a third-party service is provided directly to the owner or operator and is subject to its privacy policy, even if accessed through the Website. CHILDREN’S PRIVACY 

The Website and the services offered there are not intended for or directed to individuals under the age of 18, and we do not knowingly collect personal information from individuals under the age of 18.

As described in more detail in the “How We Use Personal Information” section of the Privacy Policy, we collect personal information to provide and manage the Website and achieve a variety of legitimate business or commercial purposes.  For example, we use personal information to fulfill or meet the reason you provided the information, to communicate with you, to operate, maintain, and provide to you the features and functionality of the Website, to market to you, for testing, research, analysis, to develop and improve our services, and for any other business and operational purpose described in the Privacy Policy and as otherwise permitted by law. 

Disclosures of Personal Information

As detailed in the “How We Disclose Personal Information” section of the Privacy Policy, we disclose personal information to fulfill specific purposes permissible under applicable laws. We may also disclose certain categories of personal information to competent governmental and public authorities and other third parties as necessary or appropriate, including when we have a legal or contractual obligation to disclose the information.

Sale or Sharing of Personal Information

We “sell” or “share” (as such terms are defined under applicable law) certain categories of personal information to and with our service providers and third parties. As detailed in the chart above, we also “sell” or “share” certain categories of personal information for analytics and advertising purposes. Refer to the chart above for additional details.  

 

We do not “sell” or “share” the personal information of minors we know to be under the age of 18 as our services are not geared toward that demographic, but instead toward other businesses and the adults who work at those businesses.

Your Legal Rights

Depending on in which state you reside and applicable data privacy laws we may grant you the right to make certain privacy requests. Even if you do not live in one of these jurisdictions, we may allow you to make the same requests, and we may take reasonable steps to fulfill them.

The Right to Request Deletion	You have the right to request the deletion or erasure of personal information we have collected from you, subject to certain exceptions.
The Right to Non-Discrimination	You have the right not to receive discriminatory treatment for exercising these rights.

How to Exercise Your Privacy Rights

If you are interested in exercising any of the above-listed rights, you can do so by sending an email to privacy@liquidtechnology.net, with the subject line “Privacy Rights Request,” or by sending a verifiable request to Privacy Request through this site’s contact form.

Upon receipt of your request, we will endeavor to honor it based on the information that we collect and maintain. Depending on the nature of your request, you will need to do the following in order for us to honor it:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we have collected personal information. This may require the matching of up to three pieces of personal information provided with your request with information we maintain in order to verify that it is you making the request. 
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We may use third parties to verify your identity and process your request.  As required by applicable law, we will evaluate your request and will respond to your request within legally required time period.  Please note that we may not take action on certain requests if we cannot verify your identity and confirm the personal information we maintain relates to you.

Authorized Agents

You may authorize someone to submit a privacy rights request on your behalf (an “authorized agent”) using the submission methods outlined above. An authorized agent will need to provide supporting information acceptable to us that you have authorized them to act on your behalf, which may be in the form of a power of attorney pursuant to applicable law. Depending on the evidence provided, we may also contact you to verify your identity directly with us or request confirmation from you that the agent is authorized to submit the request on your behalf.

Appealing Privacy Rights Decisions

You have the right to appeal a decision we have made in connection with your privacy rights request. All appeals should be submitted via email to privacy@liquidtechnology.net with the words “APPEAL PRIVACY RIGHTS” clearly indicated in the subject line. If you are unsatisfied with the way that we have handled your appeal, you may have the right to complain to your state’s Attorney General.

Other California Privacy Rights

California’s “Shine the Light” law (California Civil Code Section § 1798.83) permits users that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to privacy@liquidtechnology.net.

CHANGES TO THIS PRIVACY POLICY

We will update this Privacy Policy as needed to reflect changes in our services, the law and customer feedback. When we post changes to the Privacy Policy, we will revise the “last updated” date at the top.  If there are material changes to this Privacy Policy or how we use your personal information, we will provide you with notice by adding a statement to the Website or sending you a notification.  We encourage you to review this Privacy Policy regularly to remain informed about our information practices and the choices available to you.
